Agreement
These terms are an agreement between you and Cubeshell LLC, a Wyoming limited liability company, 1309 Coffeen Avenue STE 1200, Sheridan, WY 82801, United States, which provides Winterlamb. By using Winterlamb, you agree to these terms and to the privacy policy. When you buy a Winter Pass, you also agree to the Winter rules for that attempt.

The service
Winterlamb records your workouts. Free tracking lets you record workouts, import them from Apple Health and view your history, with no account and no time limit.
A Winter is an optional paid attempt to record a genuine workout every day for 90 consecutive days. Winterlamb is not a training plan, a medical device or a source of health advice.

Your account
An account is required only to buy a Winter Pass. You can sign in with Apple or with an email address. You are responsible for keeping your sign-in secure and must tell us at support@winterlamb.app if you believe someone else has used it.
You must be at least 13 years old, or the minimum age required by local law if higher, to create an account. If you are under 18, you must have the permission of a parent or guardian.

Winter Pass
A Winter Pass is a one-time in-app purchase that sets up one Winter attempt. Day 1 begins at the next local midnight in the time zone your iPhone detected at purchase.
The price is shown by the App Store in your currency before you buy, and payment is processed by Apple.
A pass is used by the attempt it sets up. It is not a subscription and does not renew. It cannot be transferred to another account or used for another attempt. Free tracking never requires a pass.

Refunds
Refunds for App Store purchases are requested from and decided by Apple.
If a pass is refunded, the attempt it set up is voided. Days you recorded remain in your history.
Deleting your account does not refund a pass.

Winter rules
Each attempt is governed by the version of the Winter rules you accepted at purchase. A later version applies only to later purchases, never to an attempt already in progress.
The Winter rules are available in full, with their effective date, in the app and at winterlamb.app/rules.

Acceptable use
Evidence must come from activity you actually performed. Manually entered workouts are not accepted as evidence, and submitting falsified evidence ends the attempt.
Your account is for your use only. You may not share it or use automation to generate evidence.
You may not interfere with the service, circumvent its limits, access it without authorisation, or copy, resell or reverse engineer the app, except where the law permits.

Health disclaimer
Winterlamb is not a medical device and does not provide medical advice. It records whether you were active; it does not assess whether an activity was safe, healthy or sufficient.
Winterlamb sets no minimum duration, distance, intensity or effort. You decide what you do, for how long and how hard.
Consult a qualified healthcare professional before starting or changing physical activity, especially if you have a medical condition, injury or symptoms. If you feel unwell or experience pain while exercising, stop.

No guaranteed results
Winterlamb does not promise any fitness, weight, health or performance result. Completing an attempt is not a statement about your health.

Availability
The service may be unavailable at times for maintenance or for reasons outside our control. Free recording continues to work on your iPhone when our server is unavailable.
Sync deadlines and how days are judged are set out in the Winter rules and are not changed by an outage.

Licence and ownership
Your workouts and history belong to you. We use your information only as described in the privacy policy.
Cubeshell LLC grants you a personal, non-exclusive, non-transferable licence to use Winterlamb on Apple devices that you own or control, as permitted by the App Store Usage Rules. Winterlamb, its name, the lamb mark and its design are owned by Cubeshell LLC.

Termination
You may stop using Winterlamb at any time and delete your account in the app, under Settings, then Account. Deleting your account during a Winter ends that Winter, and its pass is not refunded.
We may suspend or close an account that breaches these terms, including by submitting falsified evidence. Where reasonable, we will notify you first and give the reason.

Limitation of liability
Winterlamb is provided as is and as available. To the extent permitted by law, Cubeshell LLC makes no warranties other than those stated in these terms and is not liable for any indirect or consequential loss, loss of profit or loss of data.
To the extent permitted by law, our total liability to you is limited to the greater of the amount you paid for Winterlamb in the 12 months before the claim and 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud, or your rights as a consumer under the law of your country.

Apple
These terms are between you and Cubeshell LLC only, not Apple. Cubeshell LLC, not Apple, is solely responsible for Winterlamb and its content. Apple's Standard Licensed Application End User License Agreement also applies to your use of the app.
Apple has no obligation to provide maintenance or support for Winterlamb. Support is provided by Cubeshell LLC at support@winterlamb.app.
If Winterlamb fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Winterlamb.
Cubeshell LLC, not Apple, is responsible for addressing any claims relating to Winterlamb or your use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, claims under consumer protection, privacy or similar legislation, including in connection with HealthKit, and claims that it or your use of it infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms when using Winterlamb.
Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right to enforce them against you as a third-party beneficiary.

Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. If you are a consumer, you also benefit from the mandatory protections of the law of the country where you live and may bring proceedings in its courts.
Before bringing a claim, please contact support@winterlamb.app so we can try to resolve the matter.

Changes to these terms
We may update these terms. Each version takes effect on its stated date and applies to purchases made from that date. An attempt already set up keeps the terms and Winter rules version in effect when its pass was bought.
